From what I read in the article, I gather that the State Attorney is considering going after the employer in this instance - hence he accepted the plea deal from the driver. -- I am necromancer and I approved this poast. |

I'm not defending the driver in any way on this, because he had choices to make, and clearly he made a set of horrible ones. There is no question that he fell asleep at the wheel, but he was NOT working for those previous 34 hours. He simply left the house tired as hell after being awake for most of those 34 hours, rather than resting before he had to drive again. He offered the above statement to the Sheriff's deputy who first arrived on the scene. It was twisted by several reporters, along with a whole bunch of other crap to further sensationalize the already sensational. Crete Carriers, Inc. had an excellent safety record prior to that day, and I personally was leased to them for three years. There is NO WAY under heaven that anyone would have not known if the driver was working in excess of the hours-of-service rules. The've never allowed drivers to get away with very much in that regard. No one would EVER get away with working around the clock and another half day. We'll never know the truth to what Alvin Wilkerson actually did prior to leaving the house that day, because he took a plea deal. But we will know, when the civil trial(s) come to court, whether or not he had any reason to be tired due to carrier involvement, and knowing Crete like I do, they will likely not look as bad as some might think they will. It will come to light that the man had been home during those 34 hours. When it does, it's going to be real hard to pin it on the company.
